Estos casos de abuso requieren una investigaci\u00f3n interna y informaci\u00f3n fiable. Los abusos de empleados con acceso a informaci\u00f3n empresarial valiosa (White Collar) son de los m\u00e1s dif\u00edciles de probar. En una investigaci\u00f3n interna de abusos no se puede prescindir de especialistas competentes y de abogados.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u00bfEn qu\u00e9 consiste la defensa White Collar?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La defensa White Collar se ocupa de personas acusadas de delitos econ\u00f3micos o financieros. El nombre proviene de que estos delitos suelen cometerse en una oficina, donde tradicionalmente se trabajaba de camisa o de cuello blanco. Hablamos de fraude financiero, delitos corporativos, presentaci\u00f3n falsa de informaci\u00f3n, blanqueo de capitales y otros delitos econ\u00f3micos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Esta defensa abarca varios frentes: representar al acusado ante el tribunal, asistirle en interrogatorios y declaraciones, asesorarle legalmente, preparar el juicio y dise\u00f1ar la estrategia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Los abogados especializados en White Collar suelen tener experiencia y conocimientos espec\u00edficos en derecho penal y delitos financieros. Ayudan al acusado a defender sus derechos en el juicio y le acompa\u00f1an en todos los aspectos del proceso penal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lo habitual es que, en estos abusos, un directivo busque apropiarse de fondos u otros activos, o desviar los flujos de la empresa en su propio beneficio y en perjuicio del negocio. El abuso puede ser interno, dentro de la propia compa\u00f1\u00eda, o estar ligado a la vulneraci\u00f3n de los intereses del Estado.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<h2 class=\"wp-block-heading\"><strong>Abusos corporativos internos<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Entre los abusos corporativos internos est\u00e1n:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Manipulaci\u00f3n de secretos comerciales y de otra informaci\u00f3n que un empleado conoce por su puesto y que tiene valor para los competidores.<\/li>\n\n\n\n<li>Manipulaci\u00f3n de los estados financieros con el fin de obtener bonificaciones o preferencias por parte de los propietarios del negocio.<\/li>\n\n\n\n<li>Apropiaci\u00f3n indebida u ocultamiento de la apropiaci\u00f3n de fondos o de otros bienes de la empresa.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Tambi\u00e9n entran aqu\u00ed los abusos de altos directivos que, por sus actuaciones, llevan a la empresa a un procedimiento concursal o cometen delitos econ\u00f3micos.
