class="wp-block-paragraph">It is one of the most natural assumptions a person can make about their own will: I signed it properly at home, it says who gets what, so that is what will happen — everywhere, to everything I own. For most of an estate, in most places, that assumption holds. Where it quietly breaks is at the border. A will drawn up in London, Berlin or New York does not automatically decide the fate of a flat in Minsk, a shareholding in a Belarusian company or a balance in a Belarusian bank. It may be honoured in full; it may be honoured only in part; and for one important class of assets, Belarusian law has the final word no matter what the document says.

The question in the title has a short answer and a longer one. The short answer is: yes, a foreign will can work for Belarusian assets — but it has to pass through the right gates, and for Belarusian real estate it runs into rules that override the testator’s wishes. The longer answer is what the rest of this article is for, because the gap between “my will is valid” and “my will controls this particular asset” is exactly where families are caught out, often years later and from another country, when the estate is opened and the law turns out not to match the plan.

This article is written for the foreign owner — or the adviser of one — who holds property, accounts or a business interest in Belarus and wants to know, plainly, whether their existing will does the job. It walks through the three gates a foreign will must pass, why real estate is the hard case, how forced heirship can carve out a share the will cannot touch, and what actually has to happen — the notary, the deadline, the apostille — for the inheritance to go through. It treats inheritance law in Belarus as the practical matter it is for a cross-border family: not whether the will is a good document, but whether it will deliver the result its author intended.

The short answer, and why it is not the whole answer

Start with the reassurance, because it is real. Belarus does not ignore foreign wills. A will made abroad is not treated as a scrap of paper the moment it crosses the border; the law has rules precisely for recognising it, and in a great many estates a properly made foreign will is given effect over the deceased’s Belarusian assets with no drama at all. For movable property especially — bank balances, shares, receivables — the foreign will often controls, subject to the paperwork being in order.

So why the caution? Because “given effect” is not the same as “given effect in full.” Three separate questions sit behind every cross-border will, and people collapse them into one. Is the will formally valid? Which country’s succession law actually governs the estate? And are there heirs whose protected share the will cannot override? A foreign will can sail through the first question and still be reshaped by the second and third — and the asset where that happens most is the one foreign owners care about most, their Belarusian real estate.

Keeping those three questions apart is the single most useful thing a foreign testator can do, because each has a different answer and a different fix. The rest of this article takes them in turn, then turns to the practical machinery that makes any of it real: the Belarusian notary who opens the estate, the clock that starts running at death, and the legalised documents without which even a perfect will goes nowhere.

Three gates a foreign will must pass

Think of a foreign will arriving at the Belarusian estate as passing through three gates in sequence. Clearing one does not clear the next, and it is the combination that decides what the will actually controls.

Gate one — is the will formally valid? Belarusian private international law is generous on form. A will is not struck down merely because it was not made in the Belarusian manner: it is treated as valid as to form if it satisfies the law of the place where it was made, or the law of the country where the testator lived, or Belarusian law itself. This “whichever upholds the will” approach means a will properly executed under the rules of the testator’s home country will, in the ordinary case, clear this gate.

Gate two — which law governs the succession? This is the decisive split, and it depends on the type of asset. The succession to movable property is generally governed by the law of the country where the deceased had their last permanent place of residence. But the succession to immovable property — land and buildings — is governed by the law of the country where that property is located, and for real estate in Belarus that means Belarusian succession law, whatever the will says and wherever it was made.

Gate three — is there a protected share? Where Belarusian law governs — above all, for Belarusian real estate — it brings its forced-heirship rule with it. Certain close heirs are entitled to a compulsory share of the estate that a will cannot take away. A foreign will can leave everything to one person and still be overridden to the extent of that share. This is the gate foreign testators least expect, and the one that most often reshapes the outcome.

The table below puts the three gates together the way they actually bite — by asset. It is the heart of the article, and worth reading slowly, because it answers the title question asset by asset rather than in the abstract.

Will your foreign will control the asset?

The honest answer is “it depends on what the asset is,” so here it is set out that way, asset by asset.

Asset in Belarus

Which law governs succession

Does your foreign will control it?

Real estate (flat, house, land)

Belarusian law (law of the location)

Only within limits — forced heirship applies

Shares / participation in a Belarusian company

Law of the deceased’s last residence (generally)

Usually yes — subject to recognition

Bank accounts and cash

Law of the deceased’s last residence (generally)

Usually yes — with legalised documents

Receivables and other movables

Law of the deceased’s last residence (generally)

Generally yes

Any asset, where protected heirs exist

Belarusian forced-heirship overlay

Compulsory share is carved out first

Whether a foreign will controls a Belarusian asset, by asset type. A valid foreign will usually controls movable assets; real estate follows Belarusian succession law regardless of the will; and where protected heirs exist, the forced-heirship share is carved out before the will is given effect.

Read across the rows and the pattern is clear. For movable assets, a valid foreign will is usually the instrument that controls, and the real work is procedural: having it recognised and backing it with the right legalised papers. For real estate, the will matters, but it sits underneath Belarusian succession law and its forced-heirship rule, which can redraw the result. And the last row is the overlay that can touch any asset: where a protected heir exists, their compulsory share comes off the top before the will’s instructions are carried out. The sections that follow take the hard cases — real estate and forced heirship — in turn.

Real estate is the hard case

If there is one thing for a foreign owner to understand, it is this: your Belarusian real estate follows Belarusian succession law, not the law of your home country and not, in the parts that matter, your foreign will. The governing principle is location — immovable property is inherited under the law of the country where it sits — and a flat in Minsk or a plot outside Brest sits in Belarus. This is not a quirk of Belarusian law; the same location rule is used across much of the world for land. But it routinely surprises owners who assumed one worldwide will would carry their property cleanly to the people they named.

What does “Belarusian law governs” mean in practice for the flat? It means Belarusian rules decide who is entitled, in what shares, and subject to what protections. If the will is valid and there are no protected heirs, the will’s disposition of the real estate will generally be respected — the owner’s choice of beneficiary still counts. But if there are protected heirs, Belarusian forced heirship applies to the real estate and carves out their share first. And if the will is silent, invalid or does not reach the Belarusian property, the estate passes under Belarusian intestacy rules, by order of heirs, rather than under the home-country default the owner may have had in mind.

The practical upshot is that real estate is where a single foreign will is least able to do the whole job, and where deliberate planning pays off most. Many foreign owners of Belarusian property are best served by a will that deals specifically with the Belarusian asset — made with Belarusian succession law and forced heirship in view — alongside their home-country will, so the two fit together rather than collide. A will drafted with no awareness of the location rule is not void; it simply may not deliver what its author expected once the Belarusian rules are applied to the Belarusian flat.

Movable assets: accounts, shares and receivables

Away from real estate, the picture is friendlier to the foreign will. For movable property — money in Belarusian bank accounts, a shareholding or participation in a Belarusian company, debts owed to the deceased — the succession is generally governed by the law of the country where the deceased last permanently lived, not by the location of each asset. For a foreign testator who lived abroad, that usually means the foreign will, made under the law they lived under, is the instrument that controls these assets. The forced-heirship overlay can still apply where protected heirs exist, but the starting point is far more favourable than for land.

The catch with movables is rarely the will and almost always the access. A Belarusian bank will not release a deceased account holder’s balance, and a company registrar will not re-register a deceased shareholder’s participation, on the strength of a foreign will waved at them. They act on a Belarusian notary’s certificate of the right to inheritance — the document that formally confirms who has inherited — and that certificate is issued only once the estate has been opened, the heirs established and the papers, including the foreign will, properly recognised and legalised. The will may well control the asset; it is the procedure that turns that entitlement into a transfer.

This is also where acting from abroad becomes a practical question rather than a legal one. A foreign heir does not have to fly to Minsk and sit in a notary’s office for months; the Belarusian estate can be handled through a representative under a proper power of attorney, which is how most inheritance matters are handled without the heir being present in Belarus. The legal right to the movable asset and the logistics of collecting it are separate problems, and the second is usually solved by representation rather than travel.

Forced heirship: the share a will cannot override

Forced heirship — the compulsory share — is the rule foreign testators most often have never heard of, and the one most likely to reshape their plan. Where Belarusian succession law applies, a defined group of close heirs is entitled to a minimum share of the estate regardless of what the will says. In broad terms these are the people the law will not allow to be disinherited: minor children, and children, a spouse or parents who are unable to work, together with certain dependents. Their protected entitlement is a fraction — not less than half — of what they would have received had the deceased left no will at all. The exact circle and calculation are technical, and bound up with family-law status, but the principle is simple: some heirs cannot be written out.

The effect on a foreign will is that the compulsory share comes off the top. Suppose a testator’s will leaves their entire Belarusian estate to one person, but there is a minor child or a disabled spouse who qualifies. The will is not thereby invalid; it is overridden only to the extent of the protected share. The named beneficiary still takes the rest. This is why forced heirship is better understood as a carve-out than as a veto — it does not tear up the will, it reserves a slice of the estate for people the law protects and lets the will govern what is left.

For planning, the lesson is to find out early whether anyone in the family is a protected heir, because that single fact changes what a will can achieve over Belarusian assets. A testator who knows a compulsory share will apply can plan around it — adjusting the disposition, providing for the protected heir deliberately, structuring holdings — rather than leaving the family to discover the carve-out when the estate is opened. The rule is not a trap if you see it coming; it is only a shock to those who did not know it was there.

Making it work: the notary, the deadline and the documents

Even a will that clears every gate still has to be put into effect, and in Belarus that runs through a notary rather than a court in the ordinary case. The estate is opened — for a deceased who lived abroad but owned Belarusian property, this can be done in Belarus at the location of that property — and a Belarusian notary administers it: establishing the heirs, receiving the will, and ultimately issuing the certificate of the right to inheritance that banks, registries and the real-estate register will act on. Understanding this machinery matters, because a foreign will is only ever as good as the process that gives it effect.

The deadline. Belarusian succession runs on a clock: heirs generally have six months from the opening of the inheritance — in the usual case, from the date of death — to accept it, whether by a formal acceptance before the notary or by stepping into possession of the estate. Miss the window and reinstating the right to inherit becomes a harder, often court-bound exercise, available only on limited grounds or with the agreement of the other heirs. For a foreign family, where news of a death travels slowly and documents travel slower, six months is less comfortable than it sounds, which is why the clock should be treated as the first fact of any cross-border estate, not an afterthought.

The documents. A foreign will, and the foreign civil-status documents that go with it — death certificate, proof of relationship — do not arrive in Belarus ready to use. As a rule they must be legalised and translated: an apostille for documents from countries in the Hague Apostille Convention, or acceptance without legalisation where a legal-assistance treaty between Belarus and the country provides for it, followed by a notarised translation into Russian or Belarusian. Getting the legalisation of documents right is not a formality at the margins; a missing apostille or a defective translation can stall an otherwise straightforward inheritance for months, and it is the most common avoidable cause of delay in cross-border estates.

A word on the EU Succession Regulation — and other assumptions

Owners from the European Union often arrive with an instinct shaped by the EU Succession Regulation — the regime that lets a person’s whole estate be governed by the law of one country, and that allows a choice of their national law. It is worth being direct: that regime does not apply in Belarus. Belarus is not an EU member and is not bound by the Regulation, so an EU will’s choice-of-law clause does not, by itself, make the testator’s national law govern their Belarusian real estate. The Belarusian conflict rules decide which law applies, and for Belarusian immovables that remains Belarusian law. An EU testator relying on a professio juris to carry their home law to a Minsk flat is relying on something that stops at the EU’s edge.

A few other assumptions are worth retiring in the same breath. That a single “worldwide” will necessarily deals cleanly with Belarusian assets — often it does for movables and only partly for land. That a foreign grant of probate automatically transfers Belarusian property — it does not; the Belarusian estate is opened and administered under Belarusian procedure. And that there will be a heavy inheritance tax to plan around — there, at least, the news is good, as the next section explains. Each of these assumptions is reasonable and each is wrong often enough to cause real problems, which is the whole case for looking at the Belarusian piece specifically rather than assuming the home-country plan simply extends to it.

Inheritance Rights in Belarus

Assert your inheritance rights in Belarus with professional legal support!

 More

Is there inheritance tax in Belarus?

For once, the cross-border answer is a welcome one. Belarus abolished its separate inheritance tax in 2006, and property received by inheritance is, as a rule, not taxed in the hands of close relatives. Inheritance tax in Belarus is therefore not the obstacle that owners from higher-tax jurisdictions often brace for — a close family member inheriting a Belarusian flat is not generally met with an estate-tax bill on its value.

That is not quite the same as “no cost at all,” and it is worth being precise. Inheritances passing to people outside the close-relative circle can fall within income tax in some cases, and the inheritance process itself carries state duty and notary fees, along with the costs of legalisation, translation and, usually, local representation. These are transaction costs rather than a tax on the estate’s value, and they are modest next to the inheritance taxes of many Western countries — but they are real, and they belong in any honest reckoning of what inheriting a Belarusian asset involves. The headline, though, stands: tax is rarely the problem in a Belarusian estate. Succession law and procedure are.

When it goes to court: recognition and challenges

Most Belarusian estates are completed through the notary without a judge ever being involved. But some are not, and a foreign will raises its own flashpoints. If a notary is not satisfied that an heir’s right is established — because the foreign documents are incomplete, the position is unclear, or someone disputes it — the route forward can be the judicial recognition of an heir, a court process that establishes the right the notary could not confirm. For a foreign heir with a valid will but imperfect paperwork, this is less a disaster than a second road to the same destination, and it is a familiar one.

The sharper fights are over the will itself. A disappointed heir — very often a protected one who was left less than their compulsory share, or a relative who says the will is invalid — may bring a claim contesting the will in the Belarusian courts, which since 2026 operate under the country’s unified civil-procedure code. These disputes turn on exactly the gates this article has described: whether the will was formally valid, whether Belarusian law governs the asset in question, and whether a forced share was respected. A foreign will that was made with those questions in mind is far more defensible than one drafted as if Belarus did not exist — which is, in the end, the practical argument for planning the Belarusian part on purpose.

None of this should frighten a foreign owner away from holding Belarusian assets or from relying on a will. Disputes are the exception, not the rule, and the ordinary cross-border estate is completed quietly through a notary. The point is narrower and more useful: the estates that run into trouble are overwhelmingly the ones where the foreign will met the Belarusian rules for the first time after the death, rather than being written with them in view. That is a problem of foresight, and foresight is available.

Frequently asked questions

Is my foreign will valid in Belarus?

Usually, as to form.
