Document Legalisation: Overview

Legalisation is the process of confirming the authenticity and validity of a document for use in another country. In Belarus, legalisation takes one of two forms depending on the destination country: apostille or consular legalisation.

Apostille

An apostille is a simplified form of legalisation available for documents intended for use in the 124 states party to the 1961 Hague Convention. Documents bearing an apostille affixed by Belarusian state authorities are accepted in all other Convention states without further legalisation.

The authority responsible for affixing the apostille depends on the type of document. For example: education certificates are apostilled by the Ministry of Education of Belarus; birth and marriage certificates are apostilled by the Consular Department of the Ministry of Foreign Affairs.

How to Obtain an Apostille

An apostille is typically affixed directly to the original document. Where a certified copy is required — for example, where the original cannot be submitted — the copy is first certified by a notary, and the notary’s signature is then apostilled by the General Directorate of Justice. The state fee for affixing an apostille is 5 base units (currently 210 Belarusian rubles).

Translation of Apostilled Documents

Where an apostilled Belarusian document is to be used in a foreign country, a translation into the required language is typically needed. AMBY Legal assists with organising the translation and its certification by a Belarusian or foreign notary.

Consular Legalisation

Consular legalisation is required for documents intended for use in countries that are not party to the Hague Convention. It is a multi-step process of certifying seals and signatures — from the issuing authority through to the embassy or consulate of the destination country.

Business documents used in international trade may be legalised by the Belarusian Chamber of Commerce and Industry.

Consular Fees

The consular fee for legalisation of a Belarusian document is 1 base unit (currently 42 Belarusian rubles). For legalisation of a foreign document at a Belarusian embassy or consulate abroad, the consular fee is 50 euros.

Document Recovery

Recovery of documents issued by state bodies or organisations — birth certificates, diplomas, corporate documents, and similar — involves obtaining official duplicates. Where the client is located outside Belarus, AMBY Legal acts on their behalf under a power of attorney. Where required, we assist with legalising the power of attorney for use in Belarus.

Application for a Duplicate Document

To obtain a duplicate, an application must be submitted to the state body or organisation that originally issued the document — specifying the document name, date of issue, the name in which it was issued, and other identifying details, together with confirmation of the applicant’s identity or that of their authorised representative.

Applications for duplicate documents are typically processed within 15 days to one month.

The document is then submitted to the Main Consular Department of the Ministry of Foreign Affairs, which certifies the Ministry of Justice signature.

The final step is submission to the embassy or consulate of the destination country, which legalises the Ministry of Foreign Affairs signature with its own stamp.

Where the original document cannot be stamped directly — for example, a passport — a notarised copy is prepared as the first step.

Ministry of Justice Certification

The notary's signature on the copy is certified by the Ministry of Justice of Belarus.

Consular Legalisation Stamp

The document is then submitted to the Consular Department of the Ministry of Foreign Affairs for a legalisation stamp.

Embassy Verification

The consulate or embassy of the destination country verifies the MFA official's signature to complete the legalisation.

What must be done with a foreign-issued document for use in Belarus?
