Home Legal Support for IT Obtaining the Status of HTP Resident

What Is the HTP?

The Belarus High Technology Park (HTP) is a special economic zone supporting the IT and software development industries. It offers resident companies a distinctive legal and tax regime — including tax exemptions, simplified regulatory procedures, and contractual flexibility for cross-border operations. The HTP is not a physical location but a nationwide virtual zone, accessible to qualifying companies throughout Belarus regardless of their registered address.

Growing Your IT Business Through HTP

HTP residency provides IT companies with access to a favourable tax regime, simplified administrative procedures, and an ecosystem of qualified IT professionals. For both startups and established technology companies, HTP status delivers meaningful cost and operational advantages — including income tax and VAT exemptions, simplified currency regulation, and the ability to execute contracts with foreign counterparties electronically without physical signatures.

Belarus’s central location in Europe, affordable operating costs, and strong digital infrastructure make it a practical base for internationally-oriented IT businesses.

HTP Benefits

HTP-resident companies benefit from: significant tax reductions — including exemptions from VAT, corporate income tax, and certain other taxes; reduced social security contributions for employees; a simplified regulatory environment; the ability to execute contracts with non-residents electronically; visa-free entry to Belarus for non-resident employees; and access to a broad pool of qualified IT specialists. The HTP administration actively supports the innovation ecosystem, creating conditions for sustainable business growth.

Developing the HTP Business Plan

A business plan is a mandatory element of the HTP residency application. It must describe the company’s proposed activities within the HTP framework, demonstrate alignment with the HTP’s eligible activity categories, set out the target market and commercial model, and include financial projections. A well-structured business plan that clearly demonstrates the company’s technology focus and growth potential significantly improves the prospects of admission. AMBY Legal prepares HTP business plans tailored to the specific requirements of the HTP administration.

Document Preparation for HTP Admission

The HTP application requires a complete and accurately prepared document package — including the business plan, company founding documents (charter, registration certificates), financial statements, and proof of shareholding or ownership. All documents must comply with the regulatory standards set by the HTP and the Belarusian government. Incomplete or inaccurate submissions are a common cause of application delays. AMBY Legal manages the full document preparation process and verifies compliance before submission.

Key Considerations When Transitioning to HTP Status

Activity Alignment

Before submitting the application, confirm that the company's activities fall within the HTP's approved list. Activities outside the permitted categories can result in loss of residency status and tax benefits.

Reviewing Existing Contracts

All existing contracts must be consistent with the business plan submitted for residency registration. Discrepancies between current contracts and the proposed HTP activities may affect the application.

Tax System Transition

HTP residents do not use the simplified tax system — they operate under the general tax system. The transition should be planned in advance. Where residency status is granted mid-quarter, the general tax system applies from the first day of the month in which residency is obtained.

Accounting Adjustments

Accounting practices before and after obtaining HTP status differ. For the period before residency, the previous tax system and rates continue to apply. From the date of residency, the HTP accounting and tax regime applies.

Legislative Update

As of April 2023, residency decisions take effect from the first day of the month following the decision — rather than from the middle of a reporting period. This simplifies tax and accounting practices for newly admitted residents.

FAQ

What activities qualify a company for HTP residency in Belarus?

Eligible activities include: software analysis, design, development, and implementation — including computer games for any platform; custom software development and automated control systems; implementation and support of information systems; individual software development lifecycle phases — testing, refinement, modification; data processing; IT management consulting; and esports activities. The company must demonstrate that its primary activities fall within the approved list.

What should a company consider before applying for HTP residency?

Key considerations include: confirming that all business activities are within the approved HTP list; ensuring existing contracts are consistent with the proposed HTP business plan; planning the transition from the simplified tax system to the general tax system before applying; and preparing accounting practices for the new HTP regime. AMBY Legal advises on all of these aspects before submission.

How can existing contracts affect the HTP residency application?

Existing contracts must be aligned with the business plan submitted for residency registration. Where current contracts cover activities that fall outside the proposed HTP scope — or contradict the planned business model — they may adversely affect the application. AMBY Legal reviews existing contracts and advises on any adjustments required before submission.

What are the tax system implications of obtaining HTP status?

HTP residents must use the general tax system — not the simplified system. The transition should be planned in advance. Where residency is granted mid-quarter, the general tax system applies from the first day of the month in which the decision takes effect. Quarterly profit tax reports must be filed from that quarter onward.

How do accounting practices differ before and after HTP residency?

Before residency, accounting follows the company’s previous tax system and rates — without applying any HTP benefits. From the date of residency, accounting must comply with the HTP regime — applying the applicable tax rates and reporting requirements for HTP-resident companies.

What support does AMBY Legal provide during the HTP transition?

AMBY Legal provides: advice on eligible activities and charter amendments; preparation and submission of all application documents; business plan development; accounting and legal document preparation; tax transition planning; and representation before the HTP administration and relevant state bodies throughout the process.

Indexation of Court-Awarded Debts in Belarus: What Creditors Need to Know

You won the case. The court issued a judgment. A bailiff is nominally involved. And yet — months pass, sometimes years, and the debtor has paid little or nothing. This is a familiar situation for many creditors in Belarus, particularly foreign ones who assumed that a court order was the finish line rather than the […]

Drafting an Arbitration Clause for Contracts with Belarusian Companies: What to Include and What to Avoid (2026)

The arbitration clause is the paragraph everyone skips at signing and everyone needs when something breaks. By the time you’re reading it carefully, the chance to fix it has passed. With a Belarusian counterparty, the dispute resolution clause shapes almost everything downstream: which forum has authority, what rules apply, where the seat sits, whose law […]
