Power of Attorney in Belarus for People Living Abroad
A power of attorney – доверенность – is a formal legal document authorising one person to act on behalf of another in defined legal and official matters. For Belarusian citizens and former residents living abroad who need to take action in Belarus – sell property, manage a bank account, obtain documents, participate in inheritance proceedings, represent a company – a power of attorney to a trusted representative in Belarus is the standard solution.
Since 2023, Belarusian embassies and consulates abroad have significantly reduced the range of consular services they provide. Powers of attorney can no longer be issued at Belarusian embassies abroad in the same way as before. This change has created a significant practical challenge for Belarusian citizens living outside Belarus who need to act in Belarus through a representative.
The solution is a power of attorney issued in the country of the client’s residence – notarially certified in that country, apostilled, and then used in Belarus. Alternatively, the client can travel to Belarus and have the power of attorney certified by a Belarusian notary directly. We advise on both approaches and manage whichever is more practical for each client’s specific situation.
When a Power of Attorney Is Needed
Real estate transactions: Selling, purchasing or renting out property in Belarus without being present requires a power of attorney to a representative who can sign the transaction documents and interact with the relevant authorities.
Inheritance proceedings: Accepting inheritance in Belarus, interacting with notaries, obtaining documents from state registries and representing the heir’s interests in court – all require a power of attorney if the heir cannot travel to Belarus.
Document recovery and legalisation: Obtaining duplicate civil status documents, criminal record certificates, single status certificates and other official documents from Belarusian state authorities requires a power of attorney if the person cannot appear in person.
Company management: A foreign director or founder of a Belarusian company who cannot be present in Belarus can authorise a local representative to act on their behalf – signing documents, attending meetings, interacting with state bodies.
Banking: Managing a Belarusian bank account, closing an account, or conducting specific banking operations may require a power of attorney where the account holder is abroad.
Court proceedings: Authorising a lawyer to represent a party in Belarusian court proceedings – economic courts, civil courts, criminal proceedings.
Customs and border procedures: Authorising a representative to receive goods, complete customs declarations or handle other customs procedures.

Requirements for a Power of Attorney for Use in Belarus
Language: A power of attorney for use in Belarus must be in Russian or Belarusian – or accompanied by a notarised Russian translation if issued in another language.
Notarial certification: The power of attorney must be certified by a notary – either a Belarusian notary or a foreign notary whose certification is then apostilled.
Apostille: If issued abroad in a Hague Convention country, the notary’s certification must be apostilled by the competent authority in the country of issue. If issued in a non-Convention country, consular legalisation is required instead.
Content: The power of attorney must clearly specify the powers being granted – what actions the representative is authorised to take, in relation to which property or matters, and for what period. A vague or insufficiently specific power of attorney may be rejected by Belarusian state bodies or notaries.
Identity: The power of attorney must correctly identify both the grantor – the person granting the authority – and the attorney-in-fact – the representative being authorised. Errors in passport data or names create problems when the document is used.
Term: Belarusian law allows powers of attorney for a term of up to three years. A power of attorney without a specified term is valid for one year. Some actions – particularly real estate transactions – require the power of attorney to specify the term explicitly.

The range of consular services provided by Belarusian embassies abroad has been significantly reduced since 2023. Powers of attorney are generally no longer certified at Belarusian embassies in the same way as before. The practical route is now either to have the power of attorney certified by a notary in your country of residence – apostilled – or to travel to Belarus and use a Belarusian notary directly.
