The Legal Framework for Middle East Creditors
Middle East countries are not part of the Minsk Convention or the EAEU framework. The general rules of Belarusian procedural law apply to creditors from the region – with some country-specific variations.
Full standing for foreign companies: Any foreign company – including companies from Middle East countries – can file a claim before the Belarusian economic court without a local presence. Representation by a licensed Belarusian lawyer is required.
No sanctions barrier: Companies from the UAE, Saudi Arabia, Turkey, Qatar, Kuwait, Bahrain, Oman, Jordan, Lebanon and most other Middle East countries are not subject to the 2022 moratorium on enforcement in Belarus that affects creditors from EU member states, the United States and the United Kingdom. Middle East creditors can pursue and enforce claims in Belarus without restriction. Israel is an exception – Israel is on the Belarusian list of unfriendly states, which means Israeli creditors face the same restrictions as EU and US creditors.
Apostille position varies by country: Turkey and Israel are parties to the Hague Convention – documents from these countries require apostille. The UAE, Saudi Arabia, Qatar, Kuwait, Bahrain, Oman and most other Gulf states are parties to the Hague Convention since 2021-2024 – documents require apostille. Egypt joined the Hague Convention in 2024. Jordan and Lebanon are not parties – documents require full consular legalisation.

Debt collection for companies from UAE: The UAE is not a member of the Hague Apostille Convention. Documents from UAE state authorities – company registration certificates, court documents, notarial documents – cannot be apostilled. They require full consular legalisation: authentication by the UAE Ministry of Foreign Affairs and International Cooperation, followed by legalisation at the Belarusian embassy in the UAE. This process is more time-consuming than apostille – typically three to four weeks. All documents must be accompanied by a notarised Russian translation. UAE companies are not subject to the 2022 moratorium. Direct claim in the Belarusian economic court is the recommended route.
Debt collection for companies from Turkey: Turkey is a party to the Hague Convention – documents require apostille from the Turkish notary or court. Belarus and Turkey have a bilateral treaty on legal assistance which provides for mutual recognition of court judgments – Turkish court judgments can be recognised and enforced in Belarus through a recognition procedure. Turkish companies are not subject to the 2022 moratorium. Turkey is a major trade partner of Belarus with active commercial relationships.
Debt collection for companies from Saudi Arabia: Saudi Arabia joined the Hague Convention in 2023 – documents require apostille from the Saudi Ministry of Foreign Affairs. No bilateral treaty on mutual recognition with Belarus. Direct claim in Belarusian economic court is the recommended route. Saudi companies are not subject to the moratorium.

The 2022 moratorium on enforcement of foreign judgments applies to Israeli company creditors. Enforcement of awards in favour of Israeli legal entities is suspended. Enforcement of Turkish Court Judgments and Israeli Court Judgments in Belarus
For Turkish creditors who already have a final Turkish court judgment against a Belarusian debtor, recognition and enforcement in Belarus is available under the bilateral Belarus-Turkey legal assistance treaty. The recognition application is filed with the Belarusian economic court and decided within one month. Once recognised, enforcement proceeds through the standard enforcement authority procedure. Turkish documents require apostille under the Hague Convention. We manage the full recognition and enforcement process.
Israel is on the Belarusian list of unfriendly states. This means Israeli legal entities face the same restrictions as EU and US creditors under the 2022 framework – enforcement of awards in their favour in Belarus is suspended. Israeli individuals – private persons rather than companies – are not subject to the suspension.
For Israeli company creditors, the available options are limited but not zero. Court proceedings can still be conducted – a judgment can be obtained. Voluntary payment by the debtor is possible.
